Tuli Research Centre for India Studies ("TRIS" / "We" / "Us") is a charitable society incorporated in New Delhi, India, under the Societies Registration Act, 1860 (XXI). TRIS owns and curates research materials related to art, culture, cinema, music, and education. These materials include digital images, text, graphics, user and visual interface, books, catalogues, pop memorabilia, crafts, objects of popular culture, photographs, trademarks, logos, videos, audio, images, applications, programs, computer code, prints, and economic data on cultural events including any design, layout, or arrangement of content/information (collectively referred to as the "Content"). The Content is systematically stored and made accessible to visitors or end users ("You" / "Your" / "Users") of the Website tuliresearchcentre.org (the "Website") for purposes of study, research, and analysis. Users can search for specific Content based on its attributes in accordance with the Website's functionalities. By accessing and using the Website, You acknowledge and hereby agree to be bound by these Website Terms of Use and the privacy policy available at: https://tuliresearchcentre.org/privacy-policy ("Privacy Policy") (collectively referred to as the "Terms"). 1.1. 2.1. You agree not to use this Website or the Content for any unlawful or unauthorized purposes, including but not limited to:

  3. Website security & performance risks:
    1. Running unauthorized bots, spiders, crawlers, scrapers, or other automated programs to download the Content, algorithms or devices or any similar process to: (i) continuously and automatically search, scrape, extract, deep link or index any Content; (ii) harvest personal information from the Website for the purpose of sending unauthorised or unsolicited information or material; or (iii) undertake any activities that disrupt the Website's functionality including the working thereof or any other user's use of the Website or access to the Content;
    2. Use any device, software or any other similar function to bypass robot exclusion files or headers;
    3. Attempt to gain unauthorized access to the Website, Content or any part thereof, or any server of TRIS; or
    4. Probe, scan or test the vulnerability of the Website, or any network or server of TRIS, or breach or attempt to breach the security or authentication measures put in place by TRIS.
  4. Use of artificial intelligence: Use of the Website or Content to train, test, process, analyse, generate output or develop any artificial intelligence tool, without express prior written approval and/or license from TRIS.
  5. Inappropriate content: Uploading, storing, distributing, displaying, posting, transmitting, sharing, selling, renting, or attempting to sell or rent harmful, offensive, obscene, objectionable, defamatory, libelous, threatening or harassing, blasphemous, sexually explicit, pornographic, paedophilic, invasive to another's privacy, harmful to minors/child, racially or ethnically objectionable, disparaging, relating or encouraging money laundering, or illegal content, including content that is harmful to minors in violation of these Terms or inconsistent with laws.
  6. Inappropriate use of the Website: Distributing, displaying, posting, uploading, sharing, transmitting, selling, renting, or attempting to sell or rent any content including:
    1. advertisements/ promotional material to entice or solicit other users, including for the transmission or sale of any content that is prohibited under laws or these Terms;
    2. to conduct any business;
    3. to download or redistribute (including multiple copies of) information in the public domain for personal gain;
    4. that may be patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity, or agency for financial gain or to cause any injury to any person; or
    5. that may: (i) unjustly discriminate based on race, sex, religion, nationality, disability, sexual orientation or age; (ii) slander Us or any third party; and (iii) damage Our reputation or the reputation of any third party.
  7. Privacy violations: Collecting information of other users without consent or misrepresenting identity (including any spamming or phishing activities or impersonating another person).
  8. National interests: Engaging in activities that pose a risk to public order or may threaten the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting other nations.

2.2. We may update these Terms periodically and impose additional conditions for specific third-party content. TRIS reserves the right to suspend, terminate, or restrict access to the Website at its discretion, without prior notice, if You violate these Terms.

3. Intellectual Property Rights

3.1. TRIS respects the intellectual property rights of others, and We request our visitors and users to do the same. The Website and its Content are protected under applicable copyright, trademark, and other laws, as well as international treaties, including but not limited to the Berne Convention and the TRIPS Agreement.

5. Governing law & jurisdiction

5.1. These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any dispute arising from or in connection with the Terms shall be subject to the exclusive jurisdiction of the courts in Mumbai, India.

5.2. In any such legal proceedings, the prevailing party shall be entitled to recover all legal costs, including both taxable and non-taxable expenses, as well as reasonable attorney fees.

6. Countermeasures

6.1. TRIS reserves the right to employ any countermeasures including IP monitoring/blocking to avoid leeching, cookies, measures to prevent fingerprinting, application firewalls, regular third-party penetration tests including PCI scans and other similar mechanisms within the Website, and You agree that You and all persons and facilities under Your control will honour such countermeasures.

7. Warranty Disclaimer

7.1. TRIS shall provide the Content on the Website using a commercially reasonable level of skill and care. TRIS nor its licensors make any specific promises, representations or warranties about the Content or the Website.

7.2. The Website and its Content are provided on an "AS IS" and "AS AVAILABLE" basis. 8.2. In any case, the liability of TRIS under the Terms will not exceed INR 1000/-. The limitations in this section are applicable to the maximum/ fullest extent permitted by applicable laws.

8.3. This Clause shall survive the expiry or termination of the Terms.

9. Indemnification

9.1. You agree to defend, hold harmless and indemnify TRIS, its members, officers, employees, agents, assignees, representatives, affiliates, partners, service providers, successors and licensees from and against any and all claims, losses, costs, expenses, cause of action, suits, proceedings, damages, demands, actions or other liabilities (including attorney's fees) brought by a third party due to or arising out of or in connection with: (a) Your use of the Website or Content; or (b) Your breach of any provision of the Terms; or (c) any negligent act or omission, wilful misconduct, fraud or intentional wrongdoing on Your part; or (d) Your violation of law; (e) third-party infringement or misappropriation claims resulting from Your acts; or (f) any personal or bodily injury or damage caused in connection with Your use of the Website.

13.1 Entire agreement

13.2 Assignment of rights

13.3 Waiver

(a) In the event there is any conflict between these Terms and the Privacy Policy, and any other policies applicable to whole or part of the Website or Content, the following order of prevalence shall apply: (a) the Privacy Policy; (b) these Terms of Use; and (c) other policies.

16. Force Majeure

16.1. We shall not be liable for failing to perform or delay in performance of any obligations, or any loss or liability resulting, directly or indirectly, from such delays or interruptions due to any Force Majeure Event (as defined below).

16.2. "Force Majeure Event" shall mean an electronic or mechanical equipment failures, internet shutdowns, network interconnect problems, cyber-attacks, act of God, fire, flood, earthquake, ice storm, or other natural disaster, solar flare, explosion, monsoon, extreme weather condition, national or regional emergency, pandemic, insurrection, embargo, blockade, a governmental authority's failure to act in a timely manner, riots or other civil unrest, wars, invasions or hostilities (whether war is declared or not), acts of terrorism or threats of such acts, strikes, lockouts, labor disputes, labor stoppages or slowdowns, change in regulatory environment and/or applicable law making it impermissible or impractical to operate and maintain the Website or offer the services and similar occurrences, in the case of each of the foregoing, that are beyond the reasonable control of TRIS.

16.3. TRIS shall have no responsibility to provide You access to the Website while the interruption due to any such cause continues.
